What is marriage?  There are many who would question this due to questions surrounding gay marriage.  I have another reason to question this.  Mine is very personal.  Mine has religious as well as legal ramifications.

This is my religious dilemma:

When I married I insisted on getting married in a church because this was something I believed strongly in.  When I married I took my vows very seriously.  The circumstances surrounding my marriage were a bit unusual and this added to the strong beliefs behind my marriage.  I had known my husband for only a month and a half via phone conversations.  I flew to St Louis to meet him and we got married the same day.  We knew, in our hearts, that God had brought us together.   Due to my past, I prayed from the moment I stepped off the airplane, while standing in line at the court and up until the time I said “I DO” at the church.  I prayed that God would watch over us and I asked to be led to do God’s will; if this was his will that he would bless us in this marriage ceremony.  I prayed and I prayed and we were married.  I went into this marriage knowing that I made my vows with God as my witness.  I believed in my vows till death do us part.  I believed in my vows for better or worse, in sickness and in health, for richer or for poorer…….I believed and I promised to fulfill these vows. 

Do these vows hold true In God’s eyes if my marriage was filled with abuse and adultery against me?

Do these vows hold true if the marriage was not valid in a legal sense?

No one can ever imagine or guess the events that will happen in their life.  No one can be prepared for every twist and turn life offers.  Shortly after my marriage I learned that my husband was a crack addict.  I learned this through the trials my life was faced with.  The addiction caused my husband to do many things that are totally against what the Bible says a marriage should be.  My husband became abusive; physically, emotionally and verbally. My husband stole from me to pay for his addiction.  My husband cheated on me on a regular basis with prostitutes.  These are all things that the Bible talks against.  Adultery and abuse are both reasons for divorce.  The Bible talks about not associating with people like this.   The Bible says a person who commits adultery will not be accepted into the kingdom of heaven.  The Bible says if you commit adultery you ruin your life.  The Bible says very specifically what love is and there is no way that the things my husband did to me would be considered love.  And yet, the Bible also says a wife is to submit to her husband.  The Bible says we are to forgive 70 X’s 7 times.  I believe in God’s word…I believe I am to strive to be as Jesus was.  If someone asks for forgiveness and forgives others as he would want to be forgiven; if someone repents and accepts Jesus into his life; if that someone is born again as a new creature of God, do all his past sins matter?  Should they matter to anyone if God has forgiven and Only God can judge?

My dilemma is compounded by legal matters.

I have been married for four years now.  Even through all the trials, we have tried to work together.   Out of nowhere I receive a call from my husband’s first wife.  They are not divorced….which means I am not married…or am I?  Does it make a difference that he was not a husband to me even when we believed ourselves to be married? Does it make a difference that my husband has asked God for forgiveness and I truly believe that God will judge me to the same extend I judge others? In my mind, I must forgive and not judge my husband just as I would ask God (and my husband) to forgive me. I am not married legally, however, the question remains………am I married in God’s eyes? 

When I said my vows to my husband, I said them believing them to be true and from my heart.

If you are selling anything on your site, chances are you accept credit cards.  With credit card fraud and identity theft abound, how do you protect your e-commerce business and still offer your customers the convenience of purchasing with credit?

Credit-Cards.jpgYour responsibilities as a merchant are governed by the laws and regulations in your state, federal laws and regulations, and the specific requirements of the particular card entity (i.e. American Express, Discover, etc.).   Many of the major cards have also come together to create the PCI Standards Council.  They’ve created a series of requirements that merchants must adhere to when agreeing to accept credit cards.

So, why does all of this matter, you ask?  You’re only running a small online store.  Well, when you agree to accept credit cards, you enter into an agreement with the major cards.  As such, you agree to comply with all of these requirements.

Plus, dealing with fraud, chargebacks (amounts charged back to the credit card) and other breach hassles can be both costly (think thousands of dollars) and time consuming.

As you’re setting up your online venture, here are a few steps you can take to better protect your site and ultimately your business.

Use a Third-Party Gateway

Payment gateways are a bridge between your site and the actual payment processing that takes place.  That means that you don’t have to personally handle anyone’s credit card information.  If I purchase from your site and you use a payment gateway, I enter my information and you never see it.  The card is authorized via the payment gateway.  From a data breach perspective, that’s really important.  You don’t have to store anyone’s sensitive cardholder information which could help protect you from some liability.

Select a Reputable  Merchant Account Provider

A merchant account provider is a company that processes your card transactions and deposits the funds from the cards into your business bank account.  Beware.  Not all merchant account providers are created equal.  Some have seemingly excessive fees.  Others try to bind you to a contract term of 36 or more months.  Read the fine print of the agreements carefully, and once you’ve narrowed down your choices, sit down with your attorney to make sure you fully understand the terms of your particular contract.  The terms are legally binding, so you don’t want to enter into the agreement until it is clear to you.

Set the Strictest Possible Verification Measures

Some payment gateways give the merchant a little leeway to determine what information will be required to process the transaction.  For instance, will the cardholder be required to give the three-digit code on the back of the card?  What if the address for the cardholder does not match the billing address the online customer provides?  Will you refuse to process the purchase?  These are all decisions that you will have to make as a merchant.  The more steps you require, the greater protection you provide yourself and the cardholder.  Stricter controls may seem cumbersome, but it pays off with fewer chargebacks  and identity theft claims.

Make Sure Your Site Has a Security Certificate

Most merchant account providers and payment gateway providers require the site holder to have certain security certificates in place that encrypt data that flows over the internet.  This certificate can usually be purchased from the same company that hosts your site.  For example hosting companies like GoDaddy and Blue Host offer security certificates.  Even if your provider does not require it, it is a good idea to take the extra step to add a security certificate to your site, particularly the store portion of your site.

Verify that Your Business Insurance Covers Online Transactions

Some insurers deem online behavior to risky and specifically exclude it from coverage.  When you’re deciding on a policy to cover your business activities, read the exclusions carefully to verify that your online transactions will be covered under your existing insurance policy.  Having to address fraud claims and other possible security breaches without insurance can endanger your business and definitely lessen its profitability.

Limit Access to Sensitive Information

If for some reason you do maintain certain cardholder information, limit access to only those individuals that absolutely need to know this highly private information.  Set measures that can track when and how those individuals access this private information.

Carefully Review the Data Security Standards and All Individual Card Requirements

The PCI Standards Council issues the Data Security Standards to which every merchant must adhere.  Review them carefully.  Ask questions.  Consult with an IT person to ensure that your systems meet the requirements.

Finally, as with all agreements you enter into as a business owner, invest in a consultation with a licensed attorney in your area.  The peace of mind that comes from knowing that you’ve covered your bases will be invaluable and better equip you in the unfortunate event that you do have to defend against claims of security breach.

New ID Theft Targets Kids' SS Numbers

KANSAS CITY, Mo. – The latest form of identity theft doesn't depend on stealing your Social Security number. Now thieves are targeting your kid's number long before the little one even has a bank account.

Hundreds of online businesses are using computers to find dormant Social Security numbers — usually those assigned to children who don't use them — then selling those numbers under another name to help people establish phony credit and run up huge debts they will never pay off.

Authorities say the scheme could pose a new threat to the nation's credit system. Because the numbers exist in a legal gray area, federal investigators have not figured out a way to prosecute the people involved.

"If people are obtaining enough credit by fraud, we're back to another financial collapse," said Linda Marshall, an assistant U.S. attorney in Kansas City. "We tend to talk about it as the next wave."

The sellers get around the law by not referring to Social Security numbers. Instead, just as someone might pay for an escort service instead of a prostitute, they refer to CPNs — for credit profile, credit protection or credit privacy numbers.

Julia Jensen, an FBI agent in Kansas City, discovered the scheme while investigating a mortgage-fraud case. She has given presentations to lenders across the Kansas City area to show them how easy it is to create a false credit score using these numbers.

"The back door is wide open," she said. "We're trying to get lenders to understand the risks."

It's not clear how widespread the fraud is, mostly because the scheme is difficult to detect and practiced by fly-by-night businesses.

But the deception is emerging as millions of Americans watch their credit scores sink to new lows. Figures from April show that 25.5 percent of consumers — nearly 43.4 million people — now have a credit score of 599 or below, marking them as poor risks for lenders. They will have trouble getting credit cards, auto loans or mortgages under the tighter lending standards banks now use.

The scheme works like this:

Online companies use computers and publicly available information to find random Social Security numbers. The numbers are run through public databases to determine whether anyone is using them to obtain credit. If not, they are offered for sale for a few hundred to several thousand dollars.

Because the numbers often come from young children who have no money of their own, they carry no spending history and offer a chance to open a new, unblemished line of credit. People who buy the numbers can then quickly build their credit rating in a process called "piggybacking," which involves linking to someone else's credit file.

Many of the business selling the numbers promise to raise customers' credit scores to 700 or 800 within six months.

If they default on their payments, and the credit is withdrawn, the same people can simply buy another number and start the process again, causing a steep spiral of debt that could conceivably go on for years before creditors discover the fraud.

Jensen compared the businesses that sell the numbers to drug dealers.

"There's good stuff and bad stuff," she said. "Bad stuff is a dead person's Social Security number. High-quality is buying a number the service has checked to make sure no one else is using it."

Credit bureaus can quickly identify applications that use numbers taken from dead people by consulting the Social Security Administration's death index.

Social Security numbers follow a logical pattern that includes a person's age and where he or she lived when the number was issued. Because the system is somewhat predictable, sellers can make educated guesses and find unused numbers using trial and error.

A "clean" CPN is a number that has been validated as an active Social Security number and is not on file with the credit bureaus. The most likely source of such numbers are children and longtime prison inmates, experts said.

Robert Damosi, an analyst with Javelin Strategy & Research, said the crime can come back to hurt children when they get older and seek credit for the first time, only to discover their Social Security number has been used by someone else.

"Those are the numbers criminals want. They can use them several years without being detected," Damosi said. "There are not enough services that look at protecting the Social Security numbers or credit history of minors."

Since the mortgage meltdown of 2008, banks have tightened lending policies, but many credit decisions are still based solely on credit scores provided by FICO Inc. and the three major credit unions: Experian, TransUnion and Equifax.

Federal investigators say many businesses do not realize that a growing number of those credit scores are based on fraudulent information.

"Lenders don't understand that when they pay money to go through a service, they may be receiving false information," Jensen said. "They think when they order the information from credit bureaus, it must be true."

Without special scrutiny, credit profiles created with the scheme are not immediately distinguishable from other newly created, legitimate files.

Investigators say the businesses clearly know they are selling Social Security numbers, but it's difficult to prove. The sellers use complex disclaimers that disavow illegal activity and warn customers against using their numbers in place of Social Security numbers.

The businesses also instruct customers to provide false information when using the number to apply for credit. Customers are told to use their real name and date of birth, but to avoid listing any addresses or phone numbers they've used in the past. They're also told to avoid any other information that connects the new, clean credit profile with the old, damaged one.

Craig Watts, a spokesman for credit reporting agency FICO Inc., said FICO has tools available for businesses to protect themselves from this type of fraud, but they are not cheap. And many lenders are slow to adopt FICO's new formulas, which are updated every few years.

Some companies that sell the numbers have lavish, high-tech websites. Others run no-frills ads on sites like Craigslist.

Jim Buckmaster, president and CEO of the San Francisco-based Craigslist, recently told the AP in an e-mail that there were "fewer than 200" classifieds on his site that used the word "CPN."

Within an hour of that e-mail exchange, dozens of the ads in cities such as Las Vegas, Los Angeles and New York had been pulled from the site. Many were reposted the next day.

An AP reporter called several of the sites, but got only recordings asking callers to leave a message with contact information.

Experts say the fraud will be difficult to stop because it's so easily concealed and targets such vulnerable people. Other than checking with the credit bureaus to see if there is a credit file associated with your child's Social Security number, spokesmen at FICO, the Social Security Administration and the FTC said there are no specific tools for safeguarding the number.

"This is an invisible crime, with invisible victims who don't have enough support out there to help them," said Linda Foley of the ID Theft Resource Center in San Diego.

Ok, I rose this morning (Thank you Jesus), got the kids on the bus by 6:30, received a few phone calls around 8'ish, ate a miniature Snicker's candy bar and a few chips and began networking......Well to start, my goal today is to enroll 3 people today into the service in an attempt to help them to restore their credit to its rightfull place, follow up with some customers that have gone through the process and offer them the opportunity to join our business. So far I have a 12 noon appt. and a 6pm appt and several phone calls to make in between, but I am on a mission today.I Plan on getting one recruit today as well.My mission: Help others while also helping myself.
